Frequently asked questions – FAQs

As soon as the pregnancy is known, the employer should be informed, as the maternity protection provisions (including protection against dismissal and redundancy) apply to the pregnant woman from this point onwards.

You can find all the important information on reporting a pregnancy below under “Step 1” and at:

Arbeiterkammer: Bekanntgabe der Schwangerschaft
WKO: Meldepflichten und Kündigungsschutz bei Schwangerschaft

From the notification of an existing pregnancy until four months after the birth or four weeks after the end of parental leave, there is protection against dismissal and redundancy.

All important information on protection against dismissal and redundancy can be found at
WKO: Meldepflichten und Kündigungsschutz bei Schwangerschaft

An absolute ban on employment begins eight weeks before the birth and lasts until eight weeks after the birth. If the child is born before the expected date, maternity protection is extended by this period after the birth.

If the health or life of the mother or child is endangered by continued employment due to a medical indication pursuant to Section 2 of the Maternity Protection Ordinance, and this is certified, the maternity leave period may be extended (e.g., in the case of premature or multiple births). The employer must be notified by the end of the maternity leave period at the latest whether maternity leave is being claimed.

All important information on maternity protection can be found at:

Arbeiterkammer: Mutterschutz
oesterreich.gv.at: Mutterschutz

Parental leave may be taken until the child reaches 22 months of age. Under certain conditions, it may be extended until the child reaches 24 months of age. It may be extended until the child reaches 24 months of age if both parents take their parental leave entitlement; this also applies to single parents or families in which only one parent is entitled to parental leave and the other parent begins their leave no earlier than two months after the end of the postpartum employment restriction.

You can find all the important information about maternity leave at:

Arbeiterkammer: Karenz
Arbeiterkammer: Meldefristen für die Elternkarenz

Parental leave can be shared with the other parent, provided that each parent’s portion of the leave is at least two months. Please note that you must inform your employer in writing about your parental leave plans.

Fathers on parental leave who are employed at the MUI and have taken at least six months of continuous parental leave also have the opportunity to take part in the Medical University’s “Returning to Work Campaign” (Aktion Wiedereinstieg PLUS).

Parental part-time work is available for up to seven years, until the child’s eighth birthday. Upon completion of parental part-time work, the employee has the right to return to their original work schedule.

All important information on parental part-time work can be found at:

At the end of maternity leave, an employee has the right to return to her previous position or to a position that is at least equivalent to the one she held before her maternity leave. Exception for contract employees: These employees are entitled to the same position they held before their maternity leave, provided that the position still exists.
